We are Luxium Travels, LLC, and we’re honored to assist you in planning your travel. The following Terms & Conditions (the “Agreement”) outline the scope of our services and the responsibilities of both parties. The terms “we,” “us,” and “our” refer to Luxium Travels, LLC. The term “you” or “Traveler” refers to the individual(s) engaging our services or completing a booking through Luxium Travels, LLC.

The purchase of travel arrangements through Luxium Travels, LLC constitutes a binding contractual agreement between you (“Traveler”) and Luxium Travels, LLC (“Agency”), subject to the terms and conditions below. Please read them carefully.

1. Role of Luxium Travels

Luxium Travels, LLC acts solely as a travel agent and intermediary between you and independent suppliers of travel services, including but not limited to airlines, cruise lines, hotels, tour operators, car rental companies, and other service providers (“Suppliers”).
We do not own, operate, manage, or control these Suppliers and are not responsible for their acts, errors, omissions, representations, warranties, breaches, or negligence, nor for any personal injury, property damage, loss, accident, delay, or irregularity that may occur due to their actions or failure to act.

Our responsibility is limited to facilitating travel arrangements and securing reservations on your behalf in accordance with your instructions. Each Supplier’s own terms and conditions—including limitations of liability—apply to your booking and are binding upon you.

All requests are subject to availability and cannot be guaranteed until confirmed by the Supplier. You acknowledge that any legal recourse for dissatisfaction, damages, or disputes arising from the provision of travel services lies exclusively against the Supplier(s) and not Luxium Travels, LLC.

2. Disclaimer of Liability

Luxium Travels, LLC acts only as an agent for Suppliers in arranging travel-related services. We do not assume liability for the acts, errors, or omissions of Suppliers, nor for any injury, damage, loss, accident, delay, or irregularity that may be caused by circumstances beyond our control, including but not limited to:

  • Acts of terrorism, war, or civil unrest

  • Labor disputes or strikes

  • Mechanical or operational failures of equipment

  • Natural disasters, pandemics, or weather-related issues

  • Health risks, diseases, or quarantine requirements

  • Criminal activity or other conditions outside our influence

Unless specifically stated in writing and confirmed by us, Luxium Travels, LLC does not guarantee any Supplier’s rates, bookings, scheduling, connections, accommodations, or services.

Travelers are solely responsible for verifying and obtaining all required travel documents (including passports, visas, entry permits, vaccinations, and medical certificates) and for compliance with all destination laws and regulations. Failure to meet such requirements may result in denied boarding or entry at your own expense.

By engaging our services, you acknowledge that travel inherently involves certain risks, and you voluntarily assume all such risks, whether expected or unexpected. You are strongly encouraged to obtain comprehensive travel insurance, including coverage for trip interruption, medical emergencies, and unforeseen events.

Retention of travel documents, tickets, or confirmed reservations after issuance shall constitute your acceptance of this Agreement and your commitment to convey these terms to all other travelers in your party.

4. Acknowledgment

By booking through Luxium Travels, LLC, you acknowledge that you have read, understood, and agreed to all terms contained in this Agreement. You further agree to be bound by the terms and conditions of the relevant Suppliers and to hold Luxium Travels, LLC harmless for the acts, errors, or omissions of such independent entities.

CONCIERGE CARE RETAINER
Luxium Travels, LLC provides comprehensive travel-planning services, including personalized research, itinerary design, booking management, and full Concierge Care, ensuring dedicated support before, during, and after your trip.

Following an initial travel consultation, a non-refundable Concierge Care Retainer is required. This retainer covers destination research and itinerary development, coordination with suppliers and service providers, booking management and documentation, and ongoing concierge support throughout your travel experience.

All retainers are non-refundable and must be paid in full prior to the commencement of any planning services. If you elect not to move forward with a booking after planning has begun, the Concierge Care Retainer will still apply, as it compensates Luxium Travels for the time, professional expertise, and proprietary planning invested in crafting your travel experience.

CANCELLATION
Most travel bookings are non-refundable unless a travel-insurance plan has been purchased. Cancelled bookings may incur penalties up to 100% of the total cost, regardless of whether travel has commenced.

In addition, Luxium Travels, LLC charges a cancellation fee equal to 5% of the total booking value, in addition to any fees or penalties assessed by the relevant travel suppliers.

All cancellations must be submitted in writing to Luxium Travels prior to the scheduled departure date.

DEPOSIT AND FINAL PAYMENT
A minimum per-person deposit is required at the time of booking, the amount of which is determined by the respective supplier. All deposits are non-refundable unless expressly stated otherwise.

Final payment is due no less than 90 days prior to departure unless otherwise specified. Certain suppliers, including some airfare and special-rate bookings, may require full payment at the time of reservation.

Luxium Travels accepts major credit and debit cards. A signed payment-authorization form is required for all transactions processed by Luxium Travels, LLC.

If a payment is declined by the supplier, you will be notified, and you remain responsible for remitting the payment due to maintain your booking.

CREDIT CARD TRANSACTIONS
If any travel service provider fails to provide the services contracted, your legal remedy lies directly with that provider, not with Luxium Travels, LLC.

In the event payment has been made to Luxium Travels by credit card, you agree not to initiate a chargeback against Luxium Travels for such payment. If payment was passed directly through to the supplier and you initiate a chargeback against that supplier, you agree to indemnify and hold harmless Luxium Travels, LLC from any resulting costs, including air-debit memos or related penalties.

If Luxium Travels incurs legal or collection costs, including reasonable attorneys’ fees, to recover funds subject to an improper chargeback, you agree to be liable for those costs. If a card is declined, you guarantee immediate settlement of any outstanding amounts owed via money order, certified funds, or cash.

TRAVEL PROTECTION
For your protection, we strongly recommend purchasing trip-cancellation and travel-accident insurance.

No representation or description of insurance made by Luxium Travels constitutes a binding assurance of coverage. Luxium Travels is not an insurance company and bears no responsibility for the submission, adjudication, or payment of claims. Any claims must be filed directly with the insurance company identified in your policy.

AIRLINE FEES AND SERVICES
Airlines may impose additional fees not included in quoted package prices. These may include, but are not limited to, checked and carry-on baggage, advance seat assignments, preferred seating, extra legroom, upgrades, in-flight meals, Wi-Fi, or priority boarding.

All such fees are determined solely by the airline, are subject to change without notice, and remain the traveler’s responsibility. Luxium Travels has no control over airline fees or policies and accepts no liability for changes, increases, or unavailability of services.

Travelers must review the airline’s website for current baggage and ancillary-service policies and pay applicable fees directly to the airline.

ADDITIONAL FEES
Local taxes and surcharges that cannot be pre-collected may be charged directly by hotels, rental-car agencies, or other suppliers. Most accommodations and car-rental companies require a valid credit-card imprint at check-in.

​

RESPONSIBILITY
Luxium Travels, LLC and its employees, shareholders, subsidiaries, affiliates, officers, directors, successors, agents, and assigns do not own or operate any entity providing goods or services for your trip, including, without limitation, lodging facilities, airlines, cruise vessels, motor-coach operators, ground-transport providers, excursion organizers, or food-service companies.

All such entities are independent contractors and are not affiliated with Luxium Travels or its related entities.

LIABILITY
Luxium Travels is not liable for any negligent or willful act or failure to act of any supplier or third party.

We are not responsible for injury, loss, death, delay, inconvenience, or damage to person or property arising from, but not limited to:

  • Acts of God or force majeure

  • Illness, disease, or pandemics

  • War, civil unrest, strikes, or labor disruptions

  • Criminal or terrorist activity

  • Mechanical failures or overbooking

  • Weather conditions or schedule changes

You acknowledge that facilities abroad may not meet U.S. standards. If delays, weather, or other factors necessitate additional nights, you are responsible for related hotel, transfer, and meal expenses. Baggage travels at the owner’s risk.

Use of the Luxium Travels name on signs or vehicles is for identification only and does not indicate ownership or control.

All pricing is based on rates and exchange values in effect at the time of quotation and may change without notice. Where liability cannot be excluded, it is limited to the value of purchased travel arrangements. Luxium Travels is not liable for consequential or incidental damages.

PASSPORTS AND TRAVEL DOCUMENTATION
All travelers departing the United States must hold a valid passport with an expiration date at least six months beyond the end of travel. It is your responsibility to ensure that all required documentation, including passports, visas, and vaccination records, meets the entry requirements of each destination.

Fines, penalties, or expenses resulting from incomplete or improper documentation are the traveler’s sole responsibility. A valid government-issued ID is required for domestic travel; depending on departure state, a passport may be required in lieu of a driver’s license.

TRAVEL DOCUMENTS
Travel documents (tickets, vouchers, confirmations) serve to confirm arrangements with service providers and may be subject to restrictions such as being non-refundable or non-transferable.

All airline tickets must be issued exactly as the traveler’s passport or photo ID appears. Incorrect names, dates, or details may result in cancellation or denied boarding. Travelers are responsible for reviewing all documentation and notifying Luxium Travels of any errors at the time of booking.

Please reconfirm flight details at least 24 hours prior to departure.

HEALTH AND SPECIAL REQUIREMENTS
You are solely responsible for understanding and meeting all health or vaccination requirements for your travel destinations and for carrying appropriate medical documentation.

​

REFUSAL OF SERVICE
Service providers may refuse service at their discretion, including (but not limited to) cases in which a traveler:
(i) lacks proper documentation;
(ii) has a contagious illness;
(iii) is under the influence of alcohol, drugs, or narcotics; or
(iv) exhibits disruptive or unsafe behavior.

Luxium Travels assumes no liability for the decisions of service providers to refuse service.

ELECTRONIC OR HANDWRITTEN SIGNATURE
You may acknowledge and agree to these Terms by any of the following means:
(i) electronic signature;
(ii) handwritten signature;
(iii) electronic acknowledgment (including acceptance via email); or
(iv) implied consent through conduct, including payment of an invoice or utilization of Luxium Travels services.

All such acknowledgments shall constitute valid and binding acceptance of this Agreement.

GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict-of-law principles. Both parties submit to the exclusive jurisdiction of the courts of South Carolina for any dispute arising from or related to these Terms.

​Luxium Travels acts solely as an independent travel advisor. All travel services are provided by third-party suppliers. While we strive to ensure accuracy, pricing and availability are subject to change at any time.

Travel Insurance Notice

Luxium Travels LLC strongly recommends that all clients purchase comprehensive travel insurance to protect their investment. Travel insurance can provide valuable coverage for trip cancellations, interruptions, delays, medical emergencies, lost baggage, and other unforeseen circumstances that may arise before or during travel.

 

Clients who choose to decline travel insurance acknowledge that they are fully responsible for any financial losses or additional expenses that may occur as a result of travel disruptions, cancellations, or emergencies. By proceeding without coverage, you agree to sign a waiver releasing Luxium Travels LLC, its agents, and affiliates from any liability related to losses, injuries, or expenses incurred during your travels.

 

Luxium Travels acts solely as an intermediary between clients and travel insurance providers and is not responsible for the submission, approval, or denial of any insurance claims.
